RE: Implementation of Ordinance No. 08-133 - Certificate of Use
The Miami-Dade Board of County Commissioners (BCC) on March 3rd, 2009, implemented new procedures addressing Ordinance No. 08-133, effective 10 days after its adoption, unless vetoed by the Mayor. If vetoed, the resolutions become effective upon an override by the BCC. This ordinance applies to all residential properties such as single-family homes, condominiums, townhouses and duplexes. Resolution adopting Implementing Order 2-10 providing for a new Certificate of Use form was approved by the BCC on March 3rd, 2009. Resolution Amending Implementing Order 04-111 approved by the BCC on March 3rd, 2009, provides for a $300 fee per property for Department of Planning and Zoning review of the disclosure of findings report and issuance of a new Certificate of Use. The exact procedures, forms and schedule of fees have not yet been posted at the Miami-Dade County Department of Building and Zoning website.
As stated in our earlier bulletin dated January 29th, 2009, once the procedures are in place, agents who close residential real estate transactions constituting a first sale after a Certificate of Title is issued in a foreclosure should comply with Ordinance No. 08-133 as implemented. Fund Branch products on titles in Miami-Dade County coming out of foreclosure will include an informational note regarding proof of compliance with this ordinance.
