This course reviews the basics of the cost-plus residential construction agreement. The pandemic has affected the residential real estate market in myriad ways, including the cost of construction. Due to the spiraling cost of lumber, labor shortages, delays in the in the supply chain and other factors, contractors have increasingly moved towards the use of the cost-plus contract for the build-out of new construction. This webinar explains what the cost-plus contract is and how it differs from the fixed-price contract. Attendees will review a sample cost-plus construction agreement with attention paid to provisions of significant concern to contractors and owners. The financing of cost-plus projects will be also addressed, including the growing reliance on self-financed construction. As the form and financing of residential construction changes, so does the role of the attorney, title, and escrow agent. The course will examine the evolving duties imposed on each. This intermediate level class is designed for those generally familiar with  construction agreements.
