Description

A commonly forgotten or misunderstood aspect of due diligence for many first-time commercial buyers is proper zoning and land use investigation. Very little can be ascertained from review of a title commitment or environmental report, certainly not enough to give the full picture of potential zoning or land use challenges. This session will help the commercial real estate practitioner understand the basics of zoning and land use regulations and provide a roadmap to avoid common pitfalls that can arise from the application of governmental development regulations on existing or new commercial developments or re-developments.

Colleen C. Sachs is Senior Underwriting Counsel, Commercial Services for Attorneys’ Title Fund Services, LLC, in its branch in Pensacola, having joined The Fund in 2019. She received both a B.A. in Political Science and English and a J.D. from the University of Mississippi. Prior to becoming an underwriting counsel, Colleen was in private practice for many years. After practicing for several years in New Orleans, Louisiana, Colleen returned to her home state of Florida and maintained a practice emphasizing real estate, and land use and development law. Her experience includes extensive representation of developers of condominiums, planned unit developments, and shopping centers. Colleen is an active member of the Florida Bar Real Property, Probate & Trust Law Section, and is the current chair of the section’s Development and Land Use Planning committee and Disaster and Emergency Preparedness and Recovery committee. She is a past chair of the Florida Bar Continuing Legal Education Committee, and a current member of the Florida Realtor-Attorney Joint Committee where she serves as co-chair of the FR/Bar contract subcommittee. She also serves on the Florida Bar Diversity and Inclusion and Senior Lawyers committees. She regularly authors articles for the Fund Concept and presents seminars on real estate development, transactions, and title insurance.
