Ch. 15 – Marking up the Commitment & Immediate Post-Closing
Description
At closing, it may be expected that the title agent will “mark up” and deliver the title insurance commitment. What does this mean? How is this accomplished? In this chapter, we together mark up the Chopra to Black title commitment and consider the instruments exchanged at closing, including the all-important Closing Affidavit, and their impact on the marked-up title commitment and final title policy. Afterwards, in a class exercise, attendees will be asked to mark-up their own title insurance commitment.

KARA J. SCOTT is a native of Rhode Island and earned a degree in history from Rhode Island College in 1992 and her law degree from New England Law in Boston, MA, in 1995. She has been a member of the Rhode Island Bar since 1995 and became a member of the Florida Bar and the Connecticut Bar in 2006. Ms. Scott was a partner of a prestigious real estate firm in Rhode Island prior to relocating to Florida in 2019 where she practiced with a real estate firm in Sarasota. Prior to joining the Fund’s Legal Education Department in August, 2023, Ms. Scott’s practice focused on residential and commercial real estate transactions, business law, land use and estate administration. Ms. Scott is a member of The Florida Bar’s Real Property, Probate & Trust Law Section and the Sarasota County Bar Association.
