Seller Disclosures and Johnson v. Davis - Non-Member

Florida real estate practitioners must keep current on the ever-changing scope of disclosures imposed by Florida laws on sellers of residential real property. Many of these required disclosures emanate from new state and federal statutes. Presently, the FloridaRealtors/FloridaBar-7 form contract contains ten (10) pre-printed disclosures, but those do not represent the full breadth of disclosures that some sellers may be obligated to make.
Layered on top of these disclosure requirements is the duty imposed on residential sellers of Florida real property to disclose facts materially affecting the value of the property known to the seller, not disclosed to the buyer, and not readily observable to the buyer. This duty results from the landmark Florida Supreme Court case of Johnson v. Davis. This ruling continues to shape the duty to disclose on sellers today.
The course begins with an analysis of the pre-printed disclosures in the commonly used FR/Bar-7 form residential contract, including an understanding of their statutory underpinnings. As the course evolves, case law in which the buyer asserted a Johnson v. Davis claim as pertaining to various of the form disclosures will be reviewed. The course concludes with an overview of additional disclosures presently imposed on certain residential sellers which are not included in the FR/Bar standard contract.
