Ch. 3 – Introduction to Law, Regulations & Industry Standards
Description
Federal and state laws touch on every aspect of a real estate closing. How these laws and regulations impact transactions, from their inception, through the loan process, and concluding with certain reporting requirements at closing, are addressed in this session. In addition, the real estate practitioner needs to be aware of industry-wide standards and certain unique Florida customs that affect transactions. This session will examine such practices and standards and will also look at the various roles attorneys play in a real estate closing (legal counsel, escrow agent, title agent) and the duties pertaining to each such role.
Linda Monaco, Senior Legal Education Attorney, The Fund
Linda Monaco received her B.S. in Industrial Distribution from Texas A&M University and J.D. with honors from Quinnipiac University. She is admitted to practice in Florida, Connecticut and in the United States District Court for Connecticut. She is a Florida Board Certified Real Estate Lawyer and a Florida licensed real estate instructor. Prior to joining The Fund, Ms. Monaco was a solo practitioner and taught classes to attorneys and paralegals alike. Since joining The Fund, she has written and presented numerous seminars and webinars. Ms. Monaco has presented several times as Fund Assembly and Fund Affiliate Assembly on topics such as Best Practices, FIRPTA, Ethics, Sovereignty Lands, Liens, Probate and Trust. She has served as master of ceremonies at the Florida Fund Affiliate Assembly multiple times. She also presented Basics of FIRPTA to the National Association of Realtors ® as well as a short program on Property Assessed Clean Energy Loans (PACE Loans) to FLTA and RPPTL.
