With more than 10 years of experience, David Castellucci represents banks, lenders, and financial institutions at the intersection of financial services and real estate. He litigates matters involving breach of contract, fraud, foreclosures, replevins, collections, creditor bankruptcy, and lender liability. These include disputes under federal and state consumer protection statutes, such as the Fair Debt Collection Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA). He also advises clients on regulatory compliance and commercial lending and is an attorney authorized to issue title insurance policies.

David’s combined background in private practice and in-house roles gives him a unique, well-rounded perspective on how legal strategies impact daily operations and long-term objectives.
With experience in foreclosures, David has prevailed on appeal by defending a highly contested summary final judgment ordering the imposition and foreclosure of an equitable lien on homestead property. He has also successfully litigated bankruptcy adversary proceedings involving non-dischargeability of indebtedness, structured complex loan packages, and closed multi-million-dollar commercial loans for financial institutions.

In his commercial real estate practice, David represents buyers, sellers, lenders, and developers in transactions from due diligence to closing. Drawing on experience in both private practice and as in-house counsel for a healthcare real estate development company, he drafts loan documentation, negotiates with rights holders and associations, and works with contractors on both new developments and retrofits for office, medical, and retail properties. He also handles leasing agreements for office and medical space.
