Description

Call it death law for the dirt lawyer, this program is geared toward closing attorneys and licensed title agents looking for the most straightforward path to closing and insuring title in transactions involving a sale, mortgage, or purchase by the trustee of a trust. This program will touch on differentiating a Ch. 736 trust from a land trust or a qualified plan; explain how requirements differ for a revocable trust versus an irrevocable trust in homestead transactions; and discuss the proper use of a certification of trust with a major emphasis on relying on the language of the vesting deed if it includes homestead waiver by deed language or trust powers or both. Attendees will be provided with a quick-reference practice tool for their future transactions.

Rebecca Wood is a Senior Underwriting Counsel at Old Republic Title, having originally joined The Fund in 2014. She is a 2010 graduate of the University of Florida’s Levin College of a Law, and a 1988 graduate of King College. She became a Board-Certified Specialist in Real Estate Law in 2018. Rebecca is on the RPPTL Section’s Executive Counsel and is the immediate past Chair of the Florida Bar’s Real Estate Certification Committee. Rebecca is a contributing author to the Florida Real Property Title Examination and Insurance book, as well as being active with her local bar association.
