Description:
This course will acquaint practitioners with the concepts surrounding the separation of subsurface rights from the fee simple absolute ownership of real estate. Participants will be schooled in the common law and statutory recognition of the surface estate, aerial estate, and mineral estate. The manner in which subsurface rights are created, the rights and obligations attendant to subsurface rights holders, and the means by which rights of entry may be negated will be covered as will the impact on the issuance of title insurance products.
