Title Examination Fundamentals 101

This basic seminar is one of the Legal Education Department’s Transactional Foundations series of seminars. It is geared for the novice title examiner who has had little-to-no formal training in the mechanics and principles of title examination. Also, it may be useful for those persons who have not examined title in many years, and are seeking to refresh their title examination skills. No title searching is covered in this seminar; the seminar assumes that the examiner has the results of an appropriate title search for examination. The seminar steps the examiner through the mechanics and principles of basic title examination culminating in the preparation of a title insurance commitment. The seminar consists of a formal presentation of the principles, followed by a hands-on exercise in which a title search is examined, a title chain is developed, and a title insurance commitment is prepared. Attendees will learn about title examination maxims & principles, steps of title examination, how to create a title chain, examining deeds and mortgages, the Marketable Record Title Act, sources of Base Title, and translating title examination results into requirements or exceptions in a title insurance Commitment. Each attendee will receive a seminar book that includes a comprehensive annotated outline of the topics along with supplementary materials. This seminar is approved for 3.5 general CLE credits with The Florida Bar, and 3 hours of continuing education with NALA and DFS.

Meeting Commitment Requirements & Deleting Exceptions

The title insurance commitment plays a significant role in the closing of real estate transactions and can be a vital part of your journey to closing and issuance of the title insurance policy. This practical seminar examines and explains how to draft and meet the most commonly encountered Schedule B-I requirements and how to delete standard specific exceptions by complying with Fund guidelines and procedures. During the seminar, a Title Search Report and contract will be examined and translated into their relevant Schedule A statements, Schedule B-I requirements, and Schedule B-II exceptions. The Fund Title Notes, Standard Commitment Clauses, and Affidavit Practice Manual play a crucial role in preparing the commitment and deleting exceptions and will be used throughout the seminar as a reference. This seminar is approved for 3.5 general CLE credits and .5 ethics credit with the Florida Bar, and 3 hours of continuing education with NALA and DFS.
