This practical, essential skills seminar is one of the Legal Education Department’s Transactional Foundations series of seminars geared for real estate attorneys and their paralegal staff who desire training in reading, interpreting, and understanding surveys and legal descriptions.  This webinar addresses the concomitant title issues pertaining to surveys, general and specific survey exceptions, and coverage issues.  This webinar will prove valuable to attorneys and paralegals who conduct real estate transactions, analyze or map legal descriptions, order or read surveys, and make determinations whether a legal description or survey issue renders title unmarketable.  Whether the legal description unit of measurement involves a platted lot, a condominium unit, or is metes and bounds, take this course and go the distance.  Different types of surveys used in Florida are compared and contrasted, including ALTA/NSPS and the standards of practice.  Using real examples (including some from Fund claims files) attendees will develop survey reading skills and learn to translate examination results into title insurance requirements and exceptions.  Special emphasis will be placed upon locating, analyzing, identifying and interpreting survey anomalies – matters shown on the survey that, if not rectified, must be specifically excepted from coverage or insured against before a transaction closes.

This course will acquaint practitioners with the concepts surrounding the separation of subsurface rights from the fee simple absolute ownership of real estate. Participants will be schooled in the common law and statutory recognition of the surface estate, aerial estate, and mineral estate. The manner in which subsurface rights are created, the rights and obligations attendant to subsurface rights holders, and the means by which rights of entry may be negated will be covered as will the impact on the issuance of title insurance products.
