Negotiating the New Home Construction Agreement

Description:
This webinar focuses on representing buyers and builders-sellers of production and semi-custom single-family residences in planned communities and subdivisions. We will examine issues both common and unique to construction agreements, by which the lot owner hires the contractor to construct the home pursuant to a draw schedule, and turnkey contracts, whereby the seller-builder delivers title and the completed residence at closing. Topics addressed include deposits and related concerns, scope of work and change orders, third party financing and draw schedules, defaults and remedies, and warranties.

Foreign Seller Ahead: Proceed With Caution

Date and Time: Tuesday, April 13 (12:00 PM - 1:00 PM) 

Description:Handling a real estate transaction where the seller is not a citizen of the United States can be difficult -- so knowing and understanding the rules will help make the process easier. When a seller is foreign, the Federal Statute, 26 USC §1445 (or FIRPTA - Foreign Investment in Real Property Tax Act), comes into play. Under this law, the buyer is required to withhold and remit funds to the IRS, but it’s oftentimes difficult to determine when such remittance is required and in what amount. The seller, their accountant and the real estate agent may give the settlement agent misguided or plainly wrong information, leaving the settlement agent uncertain what to do. This program will address commonly seen FIRPTA questions and provide answers aimed to help smooth the road towards a successful closing with a foreign seller.

A Closing Agent’s Guide to the 1099-S

The Internal Revenue Service (IRS) has adopted a variety of forms to assist in its enforcement of the United States Tax Code.  Among them is Form 1099-S, Proceeds From Real Estate Transactions, used to report the sale or exchange of real estate.  The responsibility for filing this information return lies with the closing agent.  This course will review the requirements, technicalities and nuances of this form.
